TERMS AND CONDITIONS

Last Updated: 13 October 2026

Welcome to FMA Repairs / FMA Store.

These Terms and Conditions govern your use of the FMA Repairs / FMA Store website, your purchase of products through our online store, and repair services provided by FMA Repairs.

By accessing our website, placing an order, purchasing products or authorising a repair, you acknowledge that you have had the opportunity to read these Terms and Conditions.

Where applicable, a customer must expressly approve a repair quotation and any additional charges before the relevant work is undertaken.

Nothing in these Terms and Conditions is intended to exclude, restrict or waive any right or remedy that cannot lawfully be excluded under South African law.

1. ABOUT FMA REPAIRS / FMA STORE

FMA Repairs, also known as Fix My Apple Repairs, is an independent South African business providing Apple-related device repairs, replacement parts, accessories and related products.

For purposes of these Terms and Conditions, “FMA Repairs”, “FMA Store”, “we”, “us” or “our” refers to the business operating the website.

Business details

FMA Repairs offers repair services, which may include in-store, on-site and mail-in repairs, subject to availability and the applicable service arrangements.

2. ACCEPTANCE OF TERMS

These Terms and Conditions should be read together with our applicable:

  • Returns and Refund Policy;

  • Privacy Policy and POPIA Notice;

  • Product-specific warranty conditions;

  • Repair quotations and repair-specific agreements; and

  • Other policies made available on our website.

Where a specific repair quotation or warranty document applies, it should be read together with these Terms and Conditions. No document will override a mandatory legal right.

All transactions are subject to applicable South African legislation, including the Consumer Protection Act 68 of 2008, where applicable, and the Protection of Personal Information Act 4 of 2013.

3. PRODUCTS AND COMPATIBILITY

We make reasonable efforts to ensure that product descriptions, photographs, specifications and compatibility information are accurate.

However:

  • Product images may differ slightly from the actual product.

  • Packaging and product specifications may change.

  • Colours may vary depending on your display.

  • Replacement parts may be compatible only with specific device models or model numbers.

  • Product availability and specifications may change.

Customers are responsible for checking model numbers and compatibility information before ordering. If you are uncertain about compatibility, please contact FMA Repairs before purchasing.

This responsibility does not remove any rights a customer may have where a product is incorrectly described, defective or otherwise fails to comply with applicable consumer law.

4. APPLE TRADEMARK AND INDEPENDENCE DISCLAIMER

FMA Repairs / FMA Store is an independent business and is not Apple Inc. or an Apple Authorised Service Provider.

Unless expressly stated otherwise, products sold through FMA Store are replacement products or accessories and are not represented as manufactured, supplied or endorsed by Apple Inc.

Apple, iPhone, iPad, MacBook, Mac, iMac, Apple Watch and related names and trademarks belong to their respective owners. References to these names are used to identify compatible devices and the intended application of replacement parts or accessories.

FMA Repairs does not represent that a repair or replacement part is approved by Apple unless this is expressly and accurately stated.

Customers should be aware that independent repairs or replacement parts may affect certain manufacturer warranty arrangements or device features. The consequences depend on the device, the work performed and the applicable warranty terms.

5. PRODUCT AVAILABILITY

All products are subject to availability. Adding a product to a shopping cart does not guarantee availability until the order is accepted.

If a product becomes unavailable after an order has been placed, we will contact the customer and, where appropriate, offer an alternative, a replacement, a refund or another mutually agreed solution.

We will not knowingly substitute a materially different product without the customer's agreement.

6. PRICES AND PRICING ERRORS

All website prices are displayed in South African Rand (ZAR), unless otherwise stated.

Prices may change without prior notice. The price applicable to an order is the price displayed at the time of purchase, subject to genuine pricing errors and applicable law.

Delivery charges and other applicable fees will be disclosed before checkout is completed.

If an obvious pricing error occurs, we may contact the customer to explain the error and discuss the available lawful options. Where an order cannot be honoured, any payment received will be dealt with in accordance with applicable law, including any applicable refund obligations.

7. ORDERS AND PAYMENT

An order submitted through the website constitutes a request to purchase the selected products.

An order is accepted when FMA Store confirms acceptance, subject to applicable law and any stated conditions of sale.

We may decline or cancel an order where payment cannot be verified, fraud is reasonably suspected, an item is unavailable, or a material pricing or product-description error has occurred, provided we act lawfully and honour any applicable consumer rights.

Where payment has been received for an order that cannot be fulfilled, an appropriate refund will be processed.

Customers must provide accurate billing and payment information. Payments may be processed by third-party payment providers and will be subject to their applicable terms and privacy policies.

FMA Repairs / FMA Store does not knowingly store complete payment-card details where those details are handled directly by an external payment provider.

8. DELIVERY AND COURIER SERVICES

We may use third-party courier and delivery providers for product deliveries and mail-in repair services.

Delivery times are estimates unless expressly confirmed otherwise. Delays may result from courier operations, weather, public holidays, remote delivery locations, incorrect address information, supplier delays or other circumstances outside our reasonable control.

Customers must provide accurate delivery addresses and contact details.

Where additional delivery costs arise from incorrect information supplied by the customer, we may recover reasonable additional charges where legally permissible and disclosed as applicable.

Customers should retain relevant tracking details and contact us if a delivery appears to be delayed, lost or incorrectly delivered. Nothing in this section removes any applicable consumer rights relating to delivery.

9. INSPECTION OF GOODS AND REPORTING ISSUES

Customers should inspect products as soon as reasonably possible after delivery.

If a parcel appears visibly damaged, the customer should notify the courier where appropriate and contact FMA Repairs promptly.

If a product appears defective, damaged or incorrect, please contact us before attempting to install, modify or repair it.

Customers may be asked to provide their order number, proof of purchase, a description of the issue and photographs or video where appropriate. Any assessment or inspection will be handled in accordance with applicable law and our Returns and Refund Policy.

10. RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, exchanges and remedies are subject to our Returns and Refund Policy and applicable South African law.

Depending on the circumstances, a customer may qualify for a repair, replacement, refund or another remedy. Returned products may be inspected to establish the nature of the issue.

Nothing in these Terms and Conditions removes any statutory right that a customer may have in relation to defective, unsafe, incorrectly supplied or non-compliant goods.

Customers should consult our published Returns and Refund Policy for the applicable procedures, timeframes and requirements.

11. REPLACEMENT PARTS AND INSTALLATION

Replacement parts are intended for installation by suitably qualified or experienced technicians unless otherwise stated.

FMA Repairs recommends professional installation, particularly for batteries, displays, logic-board components and other sensitive electronic parts.

Customers who purchase parts for self-installation are responsible for following appropriate installation procedures and safety precautions.

Incorrect installation, misuse, modification or damage caused during installation may affect a warranty claim where the issue was caused by those actions.

However, a warranty claim will not automatically be rejected merely because a product was installed by a customer or independent technician; the facts, cause of the fault and applicable law will be considered.

Customers should not attempt an installation if they are uncertain about the procedure or the risks involved.

12. REPAIR SERVICES AND REPAIR QUOTATIONS

When FMA Repairs agrees to repair a device, the work will be based on the repair quotation, invoice or written scope of work provided to the customer.

The quotation will identify the proposed repair and applicable charges to the extent reasonably possible.

The quoted amount may include parts, labour, diagnostic services and any agreed transportation or courier charges, as specified in the quotation.

Any work or parts outside the agreed scope that will result in additional charges must be explained to the customer and approved before the additional work is undertaken.

If the customer declines a revised quotation, FMA Repairs may return the device without undertaking the additional work. Any diagnostic, consultation or assessment fee must have been disclosed and agreed to in advance, where required by law.

A diagnostic assessment does not guarantee that every fault will be identified before the device is opened or tested. Further faults may become apparent during diagnosis or repair.

Where a device is covered by an applicable FMA Repairs repair warranty, the customer may be required to provide proof of the original repair, warranty eligibility and any other reasonable information needed to assess the claim.

13. CUSTOMER CONSENT AND AUTHORISATION

By authorising a repair, the customer confirms that they are the device owner or are authorised to request the work.

The customer agrees to the quoted repair charges and the scope of work expressly approved.

Where additional labour or parts become necessary, FMA Repairs will request approval for the revised estimate before undertaking the additional work.

If approval is declined, FMA Repairs may stop the repair and arrange the return or collection of the device. Any previously disclosed and agreed diagnostic or assessment fee, and any other lawful charges already incurred, may remain payable.

FMA Repairs will not treat silence or failure to respond as approval for additional repair charges.

14. REPAIR PARTS

FMA Repairs may use new, used or refurbished parts for repairs, provided the parts are suitable for the agreed work and are accurately represented to the customer where their condition is material.

Where the type or condition of a part is material to the repair, it should be disclosed in the quotation or otherwise agreed with the customer.

Parts removed from a device may be retained by FMA Repairs where this has been agreed with the customer and is lawful. If a customer requests the return of a removed part, this should be discussed before the repair begins. Any applicable legal requirements concerning removed parts will be respected.

Replacement parts supplied as part of a repair become the customer's property once supplied or installed, subject to any lawful payment or ownership arrangements agreed for the transaction.

15. REPAIR WARRANTY

Unless a different warranty is expressly stated in writing, FMA Repairs provides a 90-day limited repair warranty on qualifying out-of-warranty repair work, subject to the scope of the repair and applicable South African law.

The repair warranty covers defects in the workmanship performed and defects in qualifying replacement parts supplied by FMA Repairs during the applicable warranty period.

The warranty does not automatically cover unrelated faults or damage that is not attributable to the repair or replacement part.

Subject to the circumstances and applicable law, the following may fall outside the repair warranty where they caused or contributed to the problem:

  • Physical impact, accidental damage or breakage occurring after the repair;

  • Liquid or moisture damage;

  • Incorrect installation or unauthorised modification;

  • Tampering or repair work by another provider;

  • Electrical damage, misuse or neglect;

  • Normal wear and tear;

  • Faults unrelated to the original repair;

  • Further damage caused by continued use of a device after a fault becomes apparent.

Battery performance, adhesives, seals and other consumable or bonding materials may be subject to specific limitations where these are disclosed in advance and permitted by law. Adhesives or seals may deteriorate with use, temperature changes or the condition of the original device. This does not exclude responsibility for defective workmanship or any other liability that cannot lawfully be excluded.

Repairs involving liquid-damaged devices require special consideration. Due to corrosion and damage that may develop over time, FMA Repairs cannot guarantee that every liquid-damaged device will be fully restored or remain functional. Any limitations applicable to such work should be explained to the customer before the repair is authorised.

Where a valid warranty claim is accepted, FMA Repairs will provide the remedy required by applicable law or the applicable warranty terms. Depending on the circumstances, this may include reworking the repair, repairing or replacing the affected part, or providing another lawful remedy.

Nothing in this section limits any mandatory statutory warranty or consumer remedy.

16. DEVICE CONDITION, PRE-EXISTING FAULTS AND DAMAGE

Electronic devices may contain existing faults, previous repair damage, corrosion, liquid exposure or other conditions that cannot be fully identified until diagnosis or disassembly.

FMA Repairs will take reasonable care when handling devices and will communicate material findings to the customer where reasonably possible.

If the device's condition makes the requested repair impractical, unsafe or unlikely to succeed, FMA Repairs may recommend alternative work or return the device without completing the repair.

Any applicable diagnostic or consultation charge must be disclosed and agreed to where required.

17. DATA, BACKUPS AND SOFTWARE

Customers should back up their devices before submitting them for repair and should retain copies of important files, photographs, contacts and other information.

Where reasonably possible, customers should remove sensitive personal information and disable security features only when necessary for the agreed repair and when safe to do so.

FMA Repairs will take reasonable care when handling customer devices but does not guarantee that data will remain intact or that data recovery will always be possible.

Repairs, software installation, operating-system updates, device restoration or troubleshooting may result in data loss, corruption, changes to settings or the need to reinstall applications.

Where a repair requires access to the device, transfer of information or installation of software, the customer authorises only the access and actions reasonably necessary to carry out the agreed service.

Any software will remain subject to its applicable licence terms. Software installations and data recovery are not covered by the repair warranty unless expressly agreed in writing.

FMA Repairs will handle personal information in accordance with its Privacy Policy and applicable data-protection law.

18. REPAIR PAYMENT AND COLLECTION

Unless otherwise agreed in writing, payment for repair services is due when the device is ready for collection or before its return or dispatch.

The customer must pay the agreed repair charges, together with any additional charges expressly approved or otherwise lawfully payable.

Where a repair is covered by an applicable FMA Repairs warranty, any charge for warranty work must be assessed in accordance with the warranty terms and applicable law.

FMA Repairs will communicate when a repaired device is ready for collection or dispatch. Customers should arrange collection or delivery within a reasonable period.

19. UNCLAIMED DEVICES

If a customer fails to collect a repaired or assessed device, FMA Repairs will make reasonable efforts to contact the customer using the contact information provided.

Where a device remains unclaimed, FMA Repairs may issue further notices and may charge reasonable, previously disclosed storage fees where legally permissible.

A device will not automatically become the property of FMA Repairs simply because it has not been collected within 30 days.

Any proposed disposal, recycling, sale or other handling of an unclaimed device will be subject to applicable South African law, the customer's rights and any lawful procedures or notices required in the circumstances.

FMA Repairs may exercise any lawful rights relating to unpaid charges, but will not treat this clause as an unrestricted right to sell or dispose of a customer's property.

Customers should ensure that their telephone number and email address remain accurate so that collection notices can reach them.

20. CUSTOMER CONTACT AND MARKETING

FMA Repairs may use customer contact information to communicate about orders, quotations, repairs, collections, warranty claims and other matters relating to the services requested.

Promotional communications will be handled in accordance with applicable privacy and electronic-communications laws. Where consent is required, marketing messages will only be sent on the required lawful basis.

Customers may opt out of promotional communications using the unsubscribe method provided or by contacting admin@fixmyapple.co.za.

Opting out of marketing will not prevent FMA Repairs from sending essential transactional or service-related communications where legally permitted.

21. PRIVACY AND PERSONAL INFORMATION

FMA Repairs collects and processes personal information where reasonably necessary to manage orders, process payments, provide repairs, arrange deliveries, communicate with customers and meet legal obligations.

Personal information will be handled in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA), where applicable.

Information may be shared with relevant service providers, including payment processors and courier companies, where necessary for the requested transaction or otherwise lawfully permitted.

FMA Repairs will take reasonable steps to safeguard personal information against unauthorised access, loss or misuse.

Customers may contact admin@fixmyapple.co.za with questions about the handling of their personal information or to exercise applicable privacy rights.

22. WEBSITE CONTENT AND AVAILABILITY

We endeavour to keep our website accurate, secure and operational. However, uninterrupted availability and complete freedom from errors cannot be guaranteed.

Website content, product information, photographs, prices and availability may be updated or corrected from time to time.

Nothing in this clause excludes any obligation imposed by law or permits misleading product representations.

23. INTELLECTUAL PROPERTY

Unless otherwise indicated, website content, including logos, graphics, product descriptions, photographs, designs, text and website layouts, may be owned by or licensed to FMA Repairs / FMA Store.

You may not reproduce, modify, distribute or commercially exploit our content without prior written permission, except where permitted by law.

Third-party names, logos and trademarks remain the property of their respective owners.

24. THIRD-PARTY SERVICES

Our website or services may use or link to third-party services, including payment providers, courier companies, social media platforms and analytics providers.

Those services may be subject to their own terms and privacy policies.

FMA Repairs is not responsible for independent third-party acts or omissions to the extent permitted by law. This does not exclude responsibility that cannot lawfully be excluded or obligations for third-party services for which FMA Repairs is legally responsible.

25. LIMITATION OF LIABILITY

FMA Repairs will exercise reasonable care when handling devices, performing repairs, supplying products and processing orders.

To the extent permitted by applicable law, FMA Repairs will not be liable for indirect or consequential losses that were not reasonably foreseeable and are not otherwise recoverable under applicable law.

FMA Repairs does not guarantee that a repair will resolve every fault, that data can always be recovered, or that a device will remain functional where pre-existing damage or unrelated faults affect its operation.

Customers are encouraged to back up their data before any repair or service.

Nothing in these Terms and Conditions excludes or limits liability for fraud, wilful misconduct, gross negligence where liability cannot lawfully be excluded, death or personal injury caused by negligence, defective goods or services, or any other matter for which exclusion or limitation is prohibited by law.

No clause in these Terms and Conditions is intended to deprive a customer of a statutory right or remedy.

26. FORCE MAJEURE

FMA Repairs will not be held responsible for delays caused by circumstances beyond its reasonable control, to the extent permitted by law. Such circumstances may include natural disasters, fires, floods, power or internet failures, civil unrest, strikes, government restrictions, courier disruptions and supplier shortages.

We will take reasonable steps to reduce the impact of such circumstances and communicate material delays where appropriate.

This clause does not remove any applicable refund obligation or other mandatory consumer remedy.

27. CHANGES TO THESE TERMS

FMA Repairs / FMA Store may update these Terms and Conditions from time to time.

The latest version will be published on our website with the applicable revision date.

Changes will not retrospectively remove rights already acquired by a customer or alter an existing agreement where doing so would be unlawful.

28. GOVERNING LAW AND DISPUTES

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the relevant courts or dispute-resolution bodies.

Customers retain any applicable rights to approach the relevant consumer-protection authorities or other lawful dispute-resolution mechanisms.

29. GENERAL TERMS

These Terms and Conditions, together with the applicable policies, accepted quotations and agreed service-specific terms, govern the relevant transaction.

Any change to a repair quotation or the agreed scope of work must be approved by the customer where required under these Terms and Conditions or applicable law.

If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent that they remain valid and enforceable.

No provision in these Terms and Conditions is intended to waive a statutory right or create a contractual restriction prohibited by law.
